Six Year Old Loses Part of Ear in Bull Mastiff Dog Bite Attack

January 25, 2012 - Most of you know I do dog bite cases. I have kids myself and I am always blown away at owners who are so irresponsible to allow something like this to happen. According to reports a six year old boy lost part of his ear when attacked by a Bull Mastiff.

According to authorities a Moreno Valley mother, her six year old son and a nine month old infant in a stroller were walking when the dog bite attack occurred on Indian Street. Authorities stated the dog that attacked the boy and his mother was a 120 pound Bull Mastiff that came out of an unsecured gated.

The six year old boy identified as _________, Jr. suffered scalp wounds and lost part of an ear in the attack and his mother was bitten on the leg, while trying to fight the dog off of her son authorities stated. They said that the injuries the boy and his mother suffered are not life threatening and the infant in the stroller was not harmed in the dog bite attack.

The Bull Mastiff was taken into the custody by animal control officials, after the attack and plan to euthanize the 120 dog after holding it for ten days to ensure it does not have rabies or other disease that could be transferred. _____________ underwent surgery to reattach the piece of ear that was damaged in the dog attack.

January 18, 2012 - According to reports a man attacked by dogs had his foot amputated, due to the severity of the attack. According to dog bite attack victim Joseph Finley, he was doing a morning run when the dog bite attack occurred. Finley said he was jogging at Rainbow Beach and on his third lap, when he saw the two pit bulls.

Finley age 62 said that when he saw them he didn’t know if they were violent or not and did not know how to handle the situation. Then the dog bite victim said he heard them growling and barking, which made him move faster and then they attacked.

Finley says he knew if he let them knock him to the ground he was in trouble. He remembers the dogs biting at his leg and foot and he knew he could not let them near his throat.

The dog bite victims says the dogs were in full attack mode and were trained killers.
Findley said he finally heard police arrive and attempt to chase the dogs, but knew that would not be enough. The officers ended up shooting the dogs, with Finley saying he heard four or five shots.

Finley was transported to Stronger Hospital, where doctors had to amputate his foot, due to the damage from the dog bite attack.

Police Dog and Officer Injured in Pursuit Crash

January, 5, 2012 - According to reports a police dog and officer were injured in a crash during a pursuit in Brea. According to Brea Police Sgt. Jim Griffin stated the pursuit that the officer was involved in began at approximately 6:00 p.m. in the westbound lanes of the 91 Freeway.

The pursuit involved a stolen motorcycle that was spotted by the Riverside police helicopter, which exited the 91 Freeway and was traveling on surface streets in Yorba Linda, according to Sgt. Griffin.

Brea police officers entered the pursuit at Bastanchury Road at Valley View Avenue, when one of the officers involved in the pursuit was involved in a collision while traveling westbound on Lambert Road at the 57 Freeway.

According to Sgt. Griffin the officer and two people in the other vehicle were transported to the hospital, but there were no injuries reported. Sgt. Griffin stated that a police dog that was in the officers vehicle was transported to a veterinarian before being taken home to his handler.

The pursuit came to an end on Las Palmas Drive and Harbor Boulevard when the rider attempted to leave the motorcycle and walk away. According to Brea Police Department the rider of the stolen motorcycle was identified as Aaron Lindwedel age 35 of La Verne, who was arrested on suspicion of vehicle theft.

Toddler Attacked by Pit Bull Suffered Head Injuries—Marijuana Found in Home

December 27, 2011 - According to reports a toddler suffered head injuries when attacked by a Pit Bull.

According to the Fullerton Police Department the Pit Bull attack occurred in the 2500 block of Larkwood in Fullerton Monday night. Police stated that when animal control officers responded to the house to look for the Pit Bull they also found marijuana plants being grown and processed.

According to authorities the child’s mother said that she was house sitting for a friend, but does not live at the house. She stated that she left room for a short time and ran back to the room, to find dog was standing over the toddler, with the child’s head bleeding. The mother then said she ran to a neighbor’s home to call paramedics.
According to authorities, the 2 year old child had a seven inch cut on his head from the dog bite attack.

October 25, 2011-According to reports a 5 year old girl attacked by a pit bull was hospitalized after being attacked in Yuba County.

According to the Yuba County Sheriff’s Department at approximately 2:15 p.m. on Monday the Pitbull attack took place in the backyard of a home located in Marysville on Pyramid Creek Drive. Four children were playing in a backyard of a home when a pit bull from another home broke through the fence where the children were playing.

One of the children when to tell the adults in the house that the pit bull was in the backyard and during this time the dog attacked a five year old girl, who was visiting the home. During the time that the mother of the five year old dog attack victim went to get the child out of the yard the mother of the three children that lived at the house got a gun and went into the backyard and shot the pit bull. The five year old girl was transported to the Rideout Memorial Hospital, where she is expected to fully recover.

Woman Injured in Two Dog Bite Attack

October 19, 2011 (by Horatio Algren) According to reports a woman was attacked by two dogs in Colton while walking her own Sheppard puppies.

According to authorities two dogs attacked a woman identified as Gina Palumbo was walking her two Sheppard puppies in the 200 block of East O Street in Colton. The woman’s 11 year old son helped the woman chase the dogs away by using a skate board, hitting one of the dogs to get it off of his mother.

The dogs have been quarantined at an animal shelter in San Bernardino and the pair is believed to be American Bulldogs.

According to authorities the dogs broke through a back fence and then a second fence to get to Palumbo and the two dogs she was walking.

Palumbo, who was hospitalized, suffered injuries to her leg and chest. She stated that she was afraid of the two large dogs and her son hit one of the dogs with the skateboard causing it to back off, he then slammed the skateboard to the ground, scaring the dogs more.

According to the dog’s owner Joanna Holguin, she witnessed the attack and the dogs did not listen to her screams for them to stop. She stated she feels like it was her fault, but that it wasn’t it was the dogs fault.

Palumbo believes that both of the dogs that attacked her should be euthanized.

Pregnant Woman Killed by Family’s Pit Bull

August 12, 2011 - According to reports a pregnant woman was mauled and killed by the family’s pit bulls.

According to Pacifica Police Department Capt. Dave Bertini the husband of Darla Norpa age 32 found his pregnant wife’s body and called police on Thursday. Greg Norpa stated to police that he had come home from work at approximately noon and found the family’s pit bulls bloody and standing over his wife’s mauled body.

According to Capt. Bertini rescue personnel arriving on the scene found Darla Norpa unresponsive in a front room of the home and found her to have massive trauma to the upper body. Greg Norpa told police that the pit bull that attacked his wife was confined in a room and was a two year old male, named Gunner. A second pit bull was trembling in a corner.

One of the pit bulls escaped into the front yard, where officers shot it three times and both of the pit bulls were transported to Peninsula Humane Society. They are the animal control services for San Mateo County and spokesman Scott Delucchi said that Friday there would be a necropsy to retrieve the bullets from the dog. The stomach contents and tissue samples would also be done to establish if the pit bull was involved in the attack.

Delucchi stated that tissue samples would also be taken from the second pit bull to see if it was also involved and if not it could be returned to Greg Nopa. He also said that he has lost his wife and unborn child, along with the one pet, this dog is all he has left.

According to Delucchi for the past 13 years they have investigated all types of dog attacks, but have never investigated one like this. He said that at this point they believe one of the pit bulls was involve and the other was not. This new amendment and existing dog regulations will give animal control officers the ability to declare a dog vicious. This is also redefining what is considered a vicious or aggressive dog, since the new amendment will not tolerate the dangerous dog.

Pit Bull Attack Leaves Robbed Victim with Torn Off Ears

June 28, 2011 - According to reports a robbery victim was attacked by a pit bull, suffering ear and other injuries.

According to authorities a man was attacked by a pit bull as a part of a robbery attempt at approximately 9:15 p.m. in the 8900 block of Painter Avenue in Whittier.

The 43 year old victim stated that three men beat him, after demanding his wallet and then the dog identified as a pit bull bit his head, neck and ears.

According to authorities the tips of the man’s ears were ripped off during the attack, by the pit bull.

The victim also stated that one of the men said they wanted to kill him. Saying “I kill you, I want to kill you.” Authorities arrested a Whittier man identified as Richard Aragon Sr., age 51 and his 16 year old son, it is alleged by the Whittier police that the 51 year old Aragon told the pit bull to attack the victim. Both were booked on suspicion of attempted robbery and assault with a deadly weapon, according to investigators.

Baby Bitten By Great Dane Hospitalized—Great Dane to be Euthanized

December 16, 2010-According to reports a baby that was taken from the mother’s arms by a Great Dane is listed in guarded condition. The infant was bitten by the Great Dane when the mother was visiting with a neighbor and the canine snatched the 6 month old girl out of her mother’s arms.

The Great Dane carried the infant approximately 200 feet before letting go of the infant, according to Moravia Police Lt. Michael Lee. According to Officer Lee the Great Dane did not grab the infant and shake her, he carried her off, but bit into her hard enough to cause significant injuries. The attack occurred at approximately 2:30 p.m. in the 600 block of Laurel Lane.

At the time of the attack the mother was holding the infant on her right shoulder standing at the door of a neighbor’s home. The Great Dane weighing about 170 pounds, took the infant out of the mothers hands, the mother and neighbor chased the 3 year old dog about 200 feet.

The infant was flown to Los Angeles County USC Medical Center and treated for injuries to the chest, a punctured lung and two broken ribs, according to Monrovia Police Capt. Jim Hunt.

The 3 year old Great Dane has been quarantined and according to Capt. Hunt has no record of being aggressive. The owners have decided to have the dog euthanized.

Murrieta Man Dies From Pit Bull Attack Complications Two Months Earlier

December 10, 2010-According to reports a Murrieta man died two months after a pit bull attack.

According to the Riverside County Coroner’s Office Edward Mitchell age 67 died on Sunday from injury complications from a Pit Bull attack.

According to reports Mitchell who lived with his nephew was attacked by the canine on October 14th. Mitchell dropped something in the backyard, which brought on the dog attack, while fighting over the object.

November 17, 2010-According to reports a woman was killed by her neighbors Pit Bulls and charges could be pending against dogs owner.

According to police who are seeking to charge the owner of the Pit Bulls November 2nd Christina Casey was found dead in her backyard. Casey who lived in Marino Valley was found with dog bites to her throat and body and according to her brother Bill Casey, she was in the process of moving partially because of the dogs.

Bill Casey stated that the two Pit Bull dogs broke through the fence over and over, and the dog’s owner was called repeatedly to get the dogs and repair the fence. According to Sgt. Jaime Briones a forensic dentist concluded the two dogs mauled the 53 year old Riverside County woman, with the fatal bite one to the throat.

Police have stated the owner has been cooperative during the investigation and the two Pit Bulls were euthanized on Tuesday. According to Sgt. Briones, investigators plant to present the case to the Riverside County district attorney’s office. July 1, 2010-According to reports a pit bull was euthanized and the mother of an infant after an April 3rd dog attack. According to reports Deputy District Attorney Gerald Fineman stated the six month old's testicles were severed. The mother identified as Carrie Rae McKinney has been charged with felony child endangerment.

The 22 year old mother a resident of San Diego County left the six month old boy unattended, while she was in another room. The incident took place on April 3rd when according to police in Murrieta she was at a friend’s home and left the infant unattended in a baby carrier in the vicinity of the pit bull mix. After several minutes they heard screams from the infant and found his diaper had been torn off and his groin area had been injured.

Animal Control seized the pit bull mix and another dog that might have been involved in the attack and both were euthanized. Fineman stated that leaving the infant alone after the dog had shown interest in the baby’s diaper warrants the mother being charged with felony child endangerment.

Mother and Children Attacked By Escaped Dogs

February 2, 2010 (by Horatio Algren) According to reports a mother and her four children were attacked by five dogs, leaving one child in critical condition.

The dog attack took place in the vicinity of Arrow Boulevard and Citrus Avenue at approximately 5:00 p.m. Monday. The woman and children were walking on a path when they were attacked by a pack of dogs, including a bull mastiff, a pit bull terrier and three other large dogs.

According to Sgt. Jeff Decker of the Fontana Police Department the dogs had escaped from a backyard after digging a hole under the fence.

The youngest child was a five year old girl who is listed in critical condition, suffering dog bites, broken ribs, a punctured lung and possible internal injuries; she was also placed on a ventilator to help her breath. Sgt. Decker stated the child was ripped from her mother’s hands by one of the dogs and shook violently by one of the dogs, leaving the mother believing she had been killed.

Another of the children a 6 or 7 year old boy was transported to the hospital with serious bite wounds on his leg, and another sister of the girl critically injured was also sustained injuries to her arms and legs. The eldest of the children an eight year old boy was not injured during the dog attack.

According to Sgt. Decker teenagers that saw the mother and her children being attacked tried to chase the pack of dogs away by throwing rocks at them. The police chased the dogs down after being alerted about the attack and the pit bull terrier was shot, the pack of dogs was impounded at the San Bernardino County Animal Shelter.

Sgt. Decker stated the owners of the dogs stated they have never been trained for sport or any activity and were concerned that the attack occurred.

Encino Man Hospitalized After Pit Bull Attack

December 14, 2009 (by Horatio Algren) According to reports a man was attacked by two pit bulls in Encino.

According to Los Angeles Police Department Detective Joel Price of the West Valley Station stated the man was walking in the 17900 block of Burbank Boulevard Sunday when the pit bull attack took place at approximately 9:45 p.m.

Detective Price said it appeared the man attempted to fight the dogs off by raising his hands and sustained bite marks to both arms. The 71 year old was then knocked to the ground by the two pit bull dogs.

The dogs were chased away from the man by a couple drivers who blew their horns and one of the dogs being moved by one of the vehicle driver’s bumpers, according to Detective Price.

According to authorities the injured man was transported to the hospital and was listed in stable condition. Detective Price stated the pit bulls had escaped from the back yard of a home nearby, where the owners were away and the house sitter did not know the dogs had escaped.

Captain Jan Selder of Los Angeles Animal Services stated an investigation has been opened and the pit bulls could be impounded or quarantined. Selder also stated that the owners might face civil or criminal charges in the dog mauling.

Orange County Accident Injures Woman and Dog

The woman was driving a Toyota Camry and slammed into a telephone pole in the area of the Lincoln Auto Spa Car Wash on Lincoln Avenue and Glassell Street in Orange, according to authorities.

Both the woman and dog were injured and needed to be extracted from the vehicle by Anaheim fire fighters. The dog was lived out of the vehicle by fire fighter Gary Vaughn and was transported to an area veterinarian by an Anaheim fire truck.

Fullerton Child Attacked By Family Pit Bull

According to reports a Fullerton 3 year old girl was attacked by the family Pit Bull. According to Fullerton Police Sgt. Mike MacDonald the daughter of a Fullerton family from the 200 block of Costa Court was mauled by the family Pit Bull after the mother and daughter had taken the canine food to where it was chained in the back yard.

The mother returned to the house, leaving the child in the back yard, where a short time later the girl’s father and 11 year old brother who were watching television heard the girl screaming.

The brother found the male Pit Bull named Fly standing over his sister according to Sgt. MacDonald. The parents rushed the girl to St. Jude Medical Center and she was later transferred to Western Medical Center in Santa Ana according to reports. The child is being treated for severe puncture wounds to her face and neck.

SUV Rollover Accident Fatally Injures Canine Passenger

According to reports there was a SUV rollover accident that fatally injured a dog that was riding in the vehicle when it was ejected.

According to California Highway Patrol Officer Denise Quesada the accident occurred in the northbound lanes of the 55 Freeway when a Ford Explored rolled over and ejected the canine that was riding in the vehicle into the southbound lanes. The driver of the vehicle was identified as 50 year old Melissa Donaldson a resident of Long Beach. Donaldson was transported to UCI Medical Center with minor injuries and the canine was transported after being treated at the scene of the accident by Orange County Animal Services. The canine died while being transported for medical treatment according to Ryan Drabeck spokesman for the Orange County Animal Services.

The rollover accident occurred south of Chapman Avenue at approximately 2:58 p.m. in the northbound carpool lane.

Due to the accident a SigAlert was issued for the 55 Freeway and it backed up traffic on both the 55 and the 22 Freeways.

Man Killed By His Own Bullmastiffs

The man whose identity is being withheld until notification of his family members according to an animal services spokesman John Welsh, was a 38 year old man who was found at the rear of his home.

His home was located at 41625 Morningside Court and the authorities were notified at approximately 5:13 p.m. stating that the man was bleeding extensively. Sheriff’s Sgt. Dennis Gutierrez found the man in his back yard, along with two full grown Bullmastiffs.

The male dog a 3 year old Butter weighted approximately 115 pounds and the female a 2 year old Ebony weighing approximately 90 pounds have both been euthanized according to animal services spokesman John Welsh.

The 38 year old mans death has been labeled suspicious and is being investigated as a dog mauling. The is an autopsy scheduled to confirm the cause of death.

Deputies were contacted and the man was pronounced dead at the scene, according to Sgt. Gutierrez it is unclear if the man was the owner of the Pit Bulls. Animal control officer were called and captured the dogs that will be euthinized.

The second dog bite attack occurred in Orange County in the vicinity of Laguna Hills according to County Animal Care Services spokesman Ryan Drabek, three Mastiff’s had to be euthanized after they attacked two people.

It is suspected a gardener might have left a gate open, which is how the dogs became loose, seriously biting a woman and biting a man in the leg when it struck them with a shovel so they would release the woman. The man has been identified as Ed Barnard, who stated the Mastiffs while attacking the woman shook her like a rag doll. This is when he and another neighbor got the dogs off of the woman and when Barnard was bitten in the leg.

The woman who was attack was said not to have life threatening injuries from the three Mastiff’s who weighted approximately 100 pounds each, attacked her.

According to Raymund Diaz this was not the first incident of an aggressive animal owned by Moody, another of Moody’s pit bull mixes attacked a woman in Moody’s home. Moody appealed a decision of the city of Westminster in a decision that had been made to euthanize the canine, whose name was Brutus. Brutus was euthanized and the woman testified in the current trial.
Diaz stated that this conviction and sentencing is the community speaking, if Moody can not control her animals then the court needs to do it for her.

The "first bite rule," and "one free bite rule" are all different names for the same legal doctrine that is used in determining if the owner of a dog or other domestic animal can be held liable for injuries that the animal may have caused. This common law protected the dog owner from civil liability if his animal had never bitten anyone before. That is why it is called the “one free bite rule”.

But it was repeatedly argued in court that the name “one bite rule” or “first bite free rule” is wrongly named because when an injury was suffered, the rule didn’t only apply to a dog bite but to other types of injuries as well. It also did not require liability if the owner had prior knowledge the dog had the propensity to bite. But once a dog had bitten the first time, any bites after that, the owner was to be held strictly liable. Eighteen states in the U.S. use the “one bite rule”. The others have modified dog bite rules.

California Civil Code section 3342 (part a), states the following:
3342. (a) The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner's knowledge of such viciousness. A person is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner.

The above portion of California Civil Code section 3342 is only part of what is known as California’s dog bite rule. The Civil Code makes dog bite California style a liability or Knowledge “scienter” Rule. This “scienter” rule makes the owner liable for any injuries caused by a dog whether he has prior knowledge that the dog might bite or not. Toddler Stable After Los Angeles Pit Bull Attack

Pit Mix Attacks Peter Strauss

There have been reports that actor Peter Strauss was ferociously attacked by a neighbors Pit Bull mix breed dog that had escaped from the owners fenced-in yard.

Strauss was in an orchard on his property in Ojai California, at the time of the attack and after being bitten broke free from the canine attack by climbing a tree. The Pit mix after some time left and went on to find another neighbor, which he then attacked also.

The 30-pound Pit Bull mix was later restrained with a looped pole used for subduing canines, by the Ventura County Department of Animal Regulation. After the dog was caught the owner surrendered the Pit mix to them and requested that it be put down.

Strauss was treated for his injuries at an area hospital and reports are that he was bitten on the legs.

YERMO, California, Dec. 27 (Smith) -- Law enforcement authorities investigated the wrongful death of Kelly Caldwell who was mauled by a pack of vicious dogs in the city of Yermo, California.

According to a local news source, sheriff investigators stated the victim of the mauling, Kelly Caldwell, forty five years of age, was attacked by the vicious dogs at approximately 9:30 p.m. Tuesday night.

Carol Tanner, Caldwell’s mother said "I heard that she was going to get a ride from somebody to the store," and "Two of the dogs were out and three others joined, I guess, because there are strays running in Yermo."

A resident living in the area who heard the mauling called authorities.

According to sheriffs department spokesperson, Arden Wiltshire, "sheriff deputies and members from the fire department, attempted to save Caldwell, but were not able to save her. The victim, Kelly Caldwell was pronounced dead at the hospital."

KABC-TV states that the dogs that were acting in a vicious manner towards law enforcement authorities have been put down. Law enforcement authorities stated that it was not known at this time how the two dogs got out from the enclosed area were they were kept, or whether any criminal charges against the owner of the two dogs will be filed.

ANDERSON (Gym Shwortz) — About one after the year turned to 2008, a man who was swearing abusively and who was holding a champagne bottle was arrested when he allowed his dog to attack a police officer. The officer was hospitalized for an animal bite and the drunken man was charged with public disorderly conduct.

Police are searching for the two dogs with the owner. Only one of the dogs went on the attack, but both left the dog attack scene that took place at approximately 1 a.m. New Year’s Day.

November 9, 2007 - Although most of us have heard of dog attacks man fact situation, in a new twist, Robert A. Schultz, the dad of an infant who had been mutilated by a little dachshund was arrested Thursday and charged he was criminally with child endangerment as well as domestic battery.

Schultz, who was 25 years at the time of arrest, is a resident att the 800 block of Eaton Lane, Lake Villa. He was arraigned in Lake County bond court. Associate Judge Theodore Potkonjak released Schultz on his own recognizance.

The charges consist of two counts of child endangerment and one count for domestic battery. The conviction of the charges could result in a sentence of up to one year in jail or probation.

The facts relate the Mr. Schultz took his 4-month-old son to his girlfriend's residence located at the 1300 block of White Oak Drive, Waukegan. His girlfriend was the owner of the dangerous dachshund. The boy was wrapped in some blankets and left on a couch alone in a room with the dog. Apparently Schultz and the woman were getting it on in a room several hours in the bedroom.

When they woke up, the heard the baby crying and screaming. Police stated the dog probably smelled baby pee which made it start to chew on the diaper. The baby began to bleed and was flown via helicopter to Lutheran General Hospital in Park Ridge.

The infant underwent surgery at Children's Memorial Hospital located at Chicago. At last check, he had been listed in stable condition. The dog was held for 10 days of observation at the local city animal shelter.

A person is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner.
(b) Nothing in this section shall authorize the bringing of an action pursuant to subdivision (a) against any governmental agency using a dog in military or police work if the bite or bites occurred while the dog was defending itself from an annoying, harassing, or provoking act, or assisting an employee of the agency in any of the following:
(1) In the apprehension or holding of a suspect where the employee has a reasonable suspicion of the suspect's involvement in criminal activity.
(2) In the investigation of a crime or possible crime.
(3) In the execution of a warrant.
(4) In the defense of a peace officer or another person.
(c) Subdivision (b) shall not apply in any case where the victim of the bite or bites was not a party to, nor a participant in, nor suspected to be a party to or a participant in, the act or acts that prompted the use of the dog in the military or police work.
(d) Subdivision (b) shall apply only where a governmental agency using a dog in military or police work has adopted a written policy on the necessary and appropriate use of a dog for the police or military work enumerated in subdivision (b).
